Reef and Tide is powered by Shopify, which enables us to provide our products and the Services to you.

Nothing in these Terms and Conditions shall affect your statutory rights as a Consumer.

We reserve the right to suspend or terminate accounts where we reasonably suspect fraud, misuse, auction manipulation, non-payment, or breach of these Terms.

4 - OUR PRODUCTS

While we take reasonable steps to accurately represent our products we cannot guarantee that the colour or appearance of the coral will be identical to the photographs displayed on our website due to differences in lighting, photography, display settings and aquarium conditions. Minor variations in colour, growth patterns, or polyp extension shall not constitute defects.
All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region or jurisdiction, on a case-by-case basis. Nothing in this section affects your statutory rights in relation to the quality, description or condition of goods supplied by us.

5 - ORDERS

When you place an order, you are making an offer to purchase. Reef and Tide reserves the right to accept or decline your order for any reason upon reasonable grounds. Your order is not accepted until Reef and Tide confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as Reef and Tide may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale.

Cancellations, returns and refunds are subject to our Return and Refund Policy, which forms part of these Terms and Conditions. Nothing in that policy affects your statutory rights.

6 - PRICES AND BILLING

Prices, discounts and promotions are subject to change without notice. The price payable for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include shipping or handling. Payment of the price and delivery charges must be made in full before the dispatch of the product or service.

7 - SHIPPING AND DELIVERY

Delivery dates and times provided by us are estimated unless expressly stated otherwise. We will take reasonable steps to ensure that orders are dispatched and delivered within the communicated timescales. We will not be responsible for delays resulting from events outside our reasonable control. 8 - WEBSITE AVAILABILITY

We take reasonable steps to ensure that the Reef and Tide website and Services are safe, secure and available. However, we cannot guarantee that the website or Services will always be available, uninterrupted, error-free or free from technical issues. We may suspend, withdraw or restrict the availability of all or any part of the website or Services where reasonably necessary, including for maintenance, security or circumstances outside our reasonable control.

Participation in any auction operated by Reef and Tide is additionally subject to the Auction Terms and Conditions, found here, which form part of these Terms and Conditions.

10 - RELATIONSHIP WITH SHOPIFY

Reef and Tide is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Reef and Tide. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Reef and Tide, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Reef and Tide.

11 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on or in the Services that contain typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).

12 - ACCOUNT SUSPENSION AND TERMINATION

We may suspend, restrict or terminate your account or access to certain Services where we reasonably believe that you have breached these Terms and Conditions or any applicable policy, failed to make payment when due, engaged in fraudulent or abusive activity, attempted to manipulate an auction, misused the website or acted in a way that may cause harm to Reef and Tide, our customers or our Services.
Where reasonably practical, we will notify you of any suspension or termination. We may take immediate action without prior notice where reasonably necessary to protect our business, customers, website or Services, prevent fraud or comply with legal or regulatory requirements.
Suspension or termination of your account does not affect any rights, obligations or liabilities that arose before the date of suspension or termination, including any amounts properly due and payable.

13 - INTELLECTUAL PROPERTY

Unless otherwise stated, all content made available through the Reef and Tide website, including our name, branding, logos, photographs, product images, graphics, text, designs and other original content, is owned by or licensed to Reef and Tide and is protected by applicable intellectual property laws.

You may access and use the website and its content for your personal, non-commercial use. You must not copy, reproduce, modify, distribute, publish, commercially exploit or otherwise use our content without our prior written permission, except where permitted by law.

Nothing in these Terms grants you any right to use the Reef and Tide name, logo, branding or other intellectual property except as expressly permitted by us.

14 - LIMITATION OF LIABILITY

Nothing in these Terms and Conditions excludes or limits any liability that cannot lawfully be excluded or limited. In particular, nothing in these Terms affects your statutory rights as a consumer or excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

Subject to the above, Reef and Tide will not be responsible for losses that were not reasonably foreseeable when the contract between you and us was formed, or for losses caused by events outside our reasonable control.

Where you are purchasing as a consumer, we supply our products and Services for private and domestic use only. We will not be responsible for business losses, including loss of profit, revenue, business, anticipated savings, business opportunity or goodwill arising from your use of our products or Services.

We cannot be responsible for the health or survival of coral after it has been introduced into your aquarium where any loss, deterioration or damage results from circumstances outside our reasonable control, including your aquarium conditions, water parameters, acclimation, handling, compatibility with other livestock, pests, disease, equipment failure or husbandry practices. This does not affect any rights or remedies you may have where a product supplied by us does not conform to your statutory rights or any applicable guarantee provided by us.

Any claim relating to the condition of coral upon delivery will be dealt with in accordance with our Shipping Policy and DOA Policy, which forms part of these Terms and Conditions.

15 - SEVERABILITY

In the event that any provision of these Terms and Conditions is determined to be unlawful, void or unenforceable, by any court of competent jurisdiction, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.

16 - WAIVER; ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.

These Terms and Conditions and any policies or operating rules posted by us on this site or in respect to the Service constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms and Conditions).

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.

If you are a consumer resident in England or Wales, any dispute arising in connection with these Terms and Conditions may be brought before the courts of England and Wales. If you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in the courts of the part of the United Kingdom in which you live.

Nothing in these Terms and Conditions affects any mandatory rights or protections you have under applicable consumer law.
